Did you know Ohio OVI penalties increase based on the number of prior OVI convictions and whether the current charge is classified as low level, high level, or refusal OVI?
A First OVI involves 3 days to 6 months of jail (often substituted with a Driver Intervention Program), fines up to $1,075, and a 1 to 3-year license suspension.
A Second OVI mandates a minimum of 10 days in jail (or alternative house arrest), fines up to $1,625, a 1 to 7-year suspension, mandatory use of an ignition interlock device, restricted license plates, and a 90-day vehicle immobilization.
By the Third OVI, jail time increases to a minimum of 30 days, fines are up to $2,750, the license suspension is 2 to 12 years, and the vehicle is subject to forfeiture.
Fourth and subsequent offenses become felony charges.
The penalties don’t stop there. For drivers under 21 years of age or carrying a commercial license face an even tougher conviction. For Standard drivers, the legal limit is a BAC ( Blood alcohol level) of 0.08% or higher. For commercial drivers the BVC is just 0.04% or higher. Meaning commercial license holders not only face more penalties and risk explosion if license, they also operate on a stricter BAC requirement. This law governing commercial drivers was put in place in 1991 by the Federal Motor Carrier Safety Administration (FMCSA). Its mission is to reduce crashes, injuries, and fatalities involving large trucks and buses.
What most car owners do not know is, by obtaining a driver’s license, motorists have “impliedly consented” to chemical testing if a law enforcement officer suspects you are impaired. Therefore, refusing a chemical test can lead to an immediate administrative license suspension (ALS), separate from any criminal penalties. Other tests may include a field sobriety test that is conducted during the traffic stop to allow the officer to assess the occupants level of sobriety. A failed sobriety test often leads to an arrest followed by a court appearing.
The bottom line is, an OVI is a costly infraction that is better to avoid if at all possible. One careless choice can lead to loss of employment, incarceration, license suspension and a mountain of legal fees. Several wrong choices can lead to permanent loss of license and felony charges. Think twice before you tip the bottle and turn the key. Ultimately it could be your last choice.
